Special Commission scrutinizing
applications of the persons dismissed on political grounds from public schools
and resource centers is giving clarification for the public, as the burden of proof
is directed towards the author in order to present and prove facts. The
abovementioned clarification addresses those persons who received a deficiency
letter regarding incomplete list of documentation presented at the Ministry.
The Commission deems it necessary to make additional clarification in order to
ease the burden of proof for applicants and provide detailed information.
In case if the list of
documents submitted to the Ministry has been proved incomplete and the
applicant has been notified, this means that the written application submitted
to the Ministry is insufficient for the Commission to prove the fact that a
person has been dismissed on political grounds. Therefore, it is necessary to
submit additional evidence.
Here are several
examples:
- If
a person considers himself/herself dismissed on political grounds, one has
to present testimony proving that the person were expressing political
views or criticizing the government in public etc. Teachers, other members
of school staff have to be witnesses proving the abovementioned facts,
indicating time, what kind of views a person was expressing, where these
views were expressed in public and a target audience.
- If
a person claims that he/she had a meeting with a governor, head of Tbilisi
City Assembly or any other public official and any of them exerted
pressure on or forced the person to quit his/her position on account of
different political views, please submit the testimony of such an
encounter taking place. A witness can be a person attending the meeting,
or witnessed a person entering a meeting or merely an accompanying person
who is capable of proving the fact of an encounter.
- If
a person was involved in activities of any political party (eg: spreading
agitation materials, ‘door to door’ etc.) and believes that this kind of
activity has been the reason of dismissal, it is obligatory to present
documents containing notice from a political party, indicating the period
and type of activity. Additionally, a notice proving that a person was
given a salary, a contract between a person and an employer (a political
party in this case) can be presented.
- If
a person has singed any kind of Party application and believes that this
has been the season of dismissal, one has to submit an application
indicating what kind of document a person has signed and when this fact
had taken place. A person may withdraw a notice from the respective
political party or movement.
- A
written testimony must contain name of a witness, address, telephone
number or any other contact information, ID number and a signature.
- If
a person is a member of any political party and believes that this has
been the reason for his/her dismissal, one has to present a document
proving the membership, indicating the date when the membership started.
- In
case a person sees a connection between the fact of his/her dismissal and
an interview given to any TV channel or a newspaper, it is required to
present a copy or a recorded version of the interview
- If
a person has appealed the order of his/her dismissal, it is required to
submit the court decision.
- Additionally,
any other material, document, information can be helpful for the
Commission.
